Acquitted Rockville HS rape suspect thinks he can get a green card

Jose Montano, the supposedly-17-year-old illegal immigrant who was charged in the Rockville High School rape case last spring, has plead guilty to a child pornography charge related to the incident, according to the Washington Post. Montano and a second suspect in the alleged gang rape of a 14-year-old female student, Henry Sanchez, were charged with possessing photos and video of the victim after Montgomery County State's Attorney John McCarthy made the bizarre declaration that he would not prosecute either man on rape charges.

McCarthy never provided any tangible evidence to support his assertion that he could not pursue the rape case, never addressed the substantial volume of forensic evidence detectives stated they had collected in the school bathroom where the alleged attack took place, and never stated that the victim had recanted her original account to police. The victim was thrown under the bus by County officials, who joined local media in a round of unprecedented victim-shaming, summing up their version of the case as, "she was asking for it."

The fact is, not a shred of evidence has been proffered by anyone that proves a gang rape did not occur, nor that the victim is no longer seeking justice in her case. Notably, the victim was never charged with filing a false report. County officials never even stated if they had verified the two men are actually the ages they claim to be - yet both may have avoided prosecution on statutory rape as a result. As it is, they skated on statutory rape charges thanks to the dirty old men who serve in the Maryland General Assembly, who have made the law such that a college student can now have legal sex with a 14-year-old. Sick.

Eager to capitalize on anti-Trump feelings in Montgomery County for sympathy, Montano's attorneys allowed Post reporter Dan Morse to observe the proceedings Friday in Montgomery County Juvenile Court. What's perhaps as troubling as the evidence-free acquittal, are the suggestions by Montano's attorney that the judge "may ultimately release Montano to his relatives," and that "he has a chance to get a green card."

Let's recap here: Two grown men sneak into United States. Are intercepted by Border Patrol. Should be sent back, but because of Obama-era policy, are instead allowed to live with relatives until a court hearing can be held in a backlogged court. Incredibly, both men enroll as "freshmen" at Rockville HS. They proceed to either gang rape, or have consensual sex with, a 14-year-old "classmate" in a school bathroom. The girl immediately reports she has been raped to the police. McCarthy announces he won't prosecute either man. Both men now believe...they should be given residency status?

Hell, no.

Release Montano to relatives? Hell, no.

Both of these men have ICE detainers on them, and should be deported immediately. Montano has his next hearing August 16; Sanchez is due in court on his own porn charges October 30. If both men are not greeted shortly after their hearings by ICE agents with restraining devices, Montgomery County officials should be held fully responsible.

According to the Post report, Montano's attorney David Wooten says Montano now knows he "needs to respect girls more." Just makes you want to give this sensitive clown a green card, right?

Get him the hell out.

The only thing as shocking as the outcome of the rape case, and the delusions of the two aliens in custody, is the absence of outrage by advocates for rape victims in the County and region about the total lack of transparency in this case. Nobody gave a damn about this girl. Montgomery County officials who have declared the two men innocent aren't facing questions or criticism, much less the recall effort facing the judge in the infamous Stanford rape case.

This is interesting, instructive, and again illuminates that Montgomery County officials - and their political allies - are held above the law. Both the Montgomery County Council and the Bell, California City Council raised their own salaries to obscene levels, while raising taxes on their constituents to record levels. Both councils also slammed their constituents with millions of dollars in highly-suspect and capricious traffic tickets.

Bell's Council is in prison. Montgomery County's Council is running for reelection.

    Dyer, you have no fucking clue how our American system of justice works. Please move to North Korea or some similar country where "guilty until proven innocent" is the rule.

    Also, please familiarize yourself with the concept of "graduated age of consent". It's not just some innovation by a couple of "dirty old men" in the Maryland General Assembly. It's the law in most states of the union.

    1. 2:11: It took more than "a couple" of dirty old men to make it legal for college students to potentially have relations with an 8th grader. Remember some crazy loophole they had probably made for themselves on another "graduated age of consent" which had to then be closed, after a 47-YEAR-OLD Maryland legislator, er, coach had a sexual relationship with a 16-year-old RICHARD MONTGOMERY HIGH SCHOOL student?

      Yeah, like I said, dirty old men in Annapolis. Sick.

      There's no evidence either Rockville HS rape suspect was innocent. That's why we have a trial, so a judge and jury can examine the extensive evidence and reach a conclusion. The victim was denied justice. A secret and arbitrary decision was made, and the political circumstances required McCarthy to provide evidence to back up his assertions, so that it could not be termed a political decision. He failed to do so.

    I'm not sure in what sense that you commented something so nasty.
    Here it is for you: "I assume that you encourage your 14 yro daughter to have sex with hundreds of boys everywhere anywhere, which I really believe so"

    What exactly did all of that show? That there was a sexual act in that bathroom - which was never in dispute?

    It may seem kinda gross to you, but sex happens in public bathrooms hundreds of times every day across the country. It doesn't imply lack of consent in any way.

    1. 9:14: I don't want to get into the gory details here, but some of the specific details cited by the victim and detectives in the police report - and the physical, forensic evidence recovered in relation to those assertions - were solid evidence that the girl had not consented on that particular day.

      I don't deny encounters take place in bathrooms, but if you choose to come illegally to a country and engage in one in a school bathroom, you shouldn't be surprised if you are placed on a Con Air flight back to your homeland.

      We've never seen Montano's picture, but let's face it, neither one of these guys looks like Antonio Banderas. Their version of the story doesn't ring very true with the mugshots.

  5. We need a merit based immigration system,for some reason I doubt that Montano and Sanchez would score very high on their merit or English skills.Lets bring in immigrants that are educated.

  6. My Great great great grandfather came to America legally in 1854 and didn't rape or kill any innocent American citizens or take welfare.My relatives did fight in the American Cival( Union ) WW I, WW II,Korea and Iraq. to answer comment @ 10:53

  10. Current progressive thinking: You must always believe women if they say they are raped...unless the alleged perpetrator is an illegal immigrant--in the latter case, she was asking for it. Imagine the protests if the alleged perpetrator was a white frat boy.

    Progressives are so blinded by their hatred of Trump that common sense goes out the window. The hypocrisy and double standards are sickening. It is amusing watching progressive friends tie themselves in knots about how the girl had allegedly sent nude photos, showing that she had consented.

    If she genuinely told the two men that she wanted to have sex with them in the high school bathroom (which I doubt, but I suppose anything is possible these days), why did she report it as a rape to the police? And are 14 year olds by law even allowed to consent to sex with adults? And how do we know how old the illegal immigrant men actually are? Studies have shown that a significant proportion are older than they say they are, so they can take advantage of benefits that come with being a child (such as being placed in the 9th grade for a free US high school education).

    Montgomery County is schizophrenic: over-regulated nanny county in most respects (i.e., permits, alcohol purchases, etc.), but lawless when it comes to illegal immigrants / open border policies. I suppose it is worth it for the Democrats in charge, with the next generations of identity-politic voters.

  12. Details of case: Two illegal Aliens
    who speak no English were enrolled in 9th grade even though they are over 18 years old.They have violent sex with an underage student in school bathroom.They are arrested and subsequently released because we feel bad that they are poor indigent well meaning young fellas who happen to come from a crime and poverty ridden country and they don't really know that they are not supposed to rape 14 year old girls.These two immigrants are the real victims in the case.

      I work with assault and domestic violence victims who tell me how painful it is to hear others hypothesize about the details of their cases.

    2. obviously there is an idea in Montgomery County that Illegal Aliens are all wonderful people who just seem to get a hard break in life,and therefore,let's just let them in the County an enroll them in our public schools,even though they don't speak English,and even though they are 3 years over the age they should be to be allowed in 9th grade.Sure,it's true that we don't really have any clue as to their true identity,but that's fine,everything is ok.I think if you really were on the side of assault and domestic violence victims,you might try and sympathize with the actual victims and not the abusers.

While it is certainly true that this young woman needs to heal after the horrible ordeal she had been through,its also true that this kind of injustice and crime is being perpetrated time after time on American Citizens throughout the country by Illegal Aliens because of Santuary Policies. This is only an issue which will be solved by debate and open discussion so people are informed.The people in the pro-amnesty and pro-sanctuary city side obviously would want to shut down any information on crimes committed by Illegal Aliens.Thats exactly what they are doing on college campuses and elsewhere.However,we do have a little thing called the First Amendment to our Constitution,which guarantees freedom of speech.I only wish the best for the young woman,I just wish the politicians in Montgomery county would feel the same way and stop enabling Illegal Aliens to commit these crimes and horrible acts.
